Liens: What are they and How do they Work?

A Lien is an arrest on title; a claim. Lien can also mean “in lieu of” [usually payment]. 

The most common example is where a mechanic has the right to hold onto a car in lieu of payment for works completed. In that case – no paperwork is needed – the mechanic’s right is universally accepted as custom.

A commercial Lien claim occurs where the Claimant is NOT in possession of property owned by the Respondent/Defendant. By expressing his Claim in a series of Affidavits and Notices, the Claimant is able to perfect a Security Interest over and in all property of the Respondent/Defendant.

Securities have “cash” value.

 

What is Money?

“Money” is any-thing which possesses the following attributes:

  • It is readily acceptable [it is a medium of exchange], and
  • It has “value” and can therefore serve as a “store” of “value”, for example: gold, or securities over real property, and
  • It has a use in and of itself, for example: gold conducts electricity and can be used to make jewelry, Lien Securities can be realised or called in. 

Conversion Process

This is how we convert your perfected securities (Commercial Lien Assets “CLAs”) into Ra-Bytz:

  • CLAs are assigned to the trustees.

  • In exchange, Capital Trust Units will be issued to assignors in accordance with our unique Monetisation Matrix.

  • Capital Trust Units produce Units of Beneficial Interest.

  • Certificates are issued to assignors showing their entitlement to UBIs.

  • In place of paper, Certificates are encrypted – hence Ra-Bytz. 

Holders of Ra-Bytz may trade their holdings as they wish, privately, until such time as we are ready to list in trading platforms, and make Ra-Bytz universally available to others. 

Ra-Bytz is backed by a pool of underlying CLAs. Ra-Bytz therefore has intrinsic value and as such may be sold or traded. In addition, Holders are entitled to distributions as underlying CLAs are monetised in line with our Liquidation strategy.
